A division bench of the Supreme Court in State of Kerala v. Asianet Satellite Communications1 (“Asianet”) allowed state-imposed entertainment taxes apart from Service Tax and acknowledged that merely transplanting the aspects theory is not suitable in the Indian context and restricted its scope to determining the applicability of a taxing statute.
