Abstract
This chapter offers an in-depth analysis of surrogacy laws in a number of countries, focusing on approaches to surrogacy taken by various jurisdictions. It takes into consideration issues arising from cross border surrogacy arrangements, particularly disputes involving conflicting national laws as well as an emerging phenomenon defined as ‘surrogacy tourism’. This chapter is intended to serve as a map for understanding global surrogacy laws and for gaining insight into ongoing debates concerning future regulation possibilities. It conducts a thorough examination of the ethical quandaries that are inherent in commercial surrogacy partnerships, scrutinizing the moral ramifications of reproduction as a commercial transaction.
