Abstract

The shift in the inquiry from empirical to normative signals the emergence of a new field of study in its own right. As the youngest branch of private law, there are parts of the law of unjust enrichment that are still unclear. In many jurisdictions, including India, the nature of inquiry regarding this field of law has firmly transitioned from questions regarding the existence of the field to questions such as what ought to be the normative basis of the field. The unjust enrichment law in India did not witness the general uncertainty experienced in other common law jurisdictions. This was primarily due to the codification of parts of the law through the enactment of the Indian Contract Act in the nineteenth century.
