Abstract

The tourism industry in India has seen rapid growth, with domestic tourism alone witnessing 1.7 billion trips in 2023. Consumers, spending large sums on various travel packages, are often reliant on tour operators for a seamless experience. The Consumer Protection Act, 2019, governs the relationship between consumers and travel operators, ensuring that consumers are protected from unfair practices. This paper explores consumer rights under the Act, particularly in the context of common issues such as last-minute changes in itineraries and cancellations due to visa rejections. Through case studies like MakeMyTrip vs Manvendra Saha Roy (2019) and MakeMyTrip v. Dr. S. Nagarajan (2024), the paper highlights how the National Consumer Commission has ruled in favor of consumers in instances of unfair trade practices, such as unnotified itinerary changes and stringent cancellation policies. The paper also outlines essential precautions consumers should take before booking tours, including obtaining written itineraries, understanding cancellation policies, and verifying the operator's credentials. Finally, it provides a guide on how consumers can file complaints with consumer commissions and the types of compensation they may be entitled to. This analysis emphasizes the importance of documentation and transparency in ensuring consumer protection in the growing Indian tourism sector.
