Abstract
The Calcutta High Court has recently nullified the entire selection process for appointments in school jobs, conducted by the Government of West Bengal, on the grounds of systemic fraud, resulting in 24,000 job losses. The arguments for the sustainability of the high court order are premised upon (i) “systemic fraud” in the process, (ii) impossibility and impracticability of redemptive governmental actions, and (iii) violation of equal opportunity under Articles 14 and 16 of the Indian Constitution.
