Abstract
In The Proof: Uses of Evidence in Law, Politics, and Everything Else, Schauer often uses the words evidence and proof interchangeably, yet the title clearly outlines the intended difference between both. Drawing from the author’s previous work,evidence can be understood to denote information used to answer a question of some interest drawn from observed or statistical data, offered by a layperson (p. 82) or an expert (p. 185), including a scientist (p. 145). On the other hand, proof is a measure of that evidence, either in quantity, quality, or a combination of both, that adequately suffices to help the decision-maker reach a factual or inferential conclusion from that evidence (p. 23). Therefore, the value of evidence is judged in so far as it helps the assessor prove a conclusion.
