Abstract

Force Majeure is defined as the superior or irresistible force in the law of insurance[1] which allows parties to a contract the opportunity to default if the performance becomes impossible due to occurrence of any unforeseeable events. It has also been cited as an excuse for the failure to perform the legal duties[2]. This provision saves parties from performing contractual obligations due to factors over which they have no control[3]. Various nations have developed their theories of impossibility and frustration in England & the United States and France respectively. Under the French law, force majeure is an event that is unforeseeable, unavoidable and external that makes execution impossible[4]
