This article focuses on the distribution of benefits and burdens in the society in the Indian context. This article aims to reinterpret the distributiveness of the Indian Constitution through the perspective of Critical Legal Studies. It is argued that though the Indian Constitution is founded on the idea of distributive justice, it neither supports a pure libertarian form of justice nor supports a purely strict egalitarian form of distributive justice. This article explains the concept of Critical Legal Studies, Distributive Justice schemes and then analyzes the Constitution and various Indian laws to support the claim and concludes that that Indian Constitution, to a limited extent, promotes reducing of injustice to achieve justice rather than actively promoting distributive justice ideas.
