Abstract
This chapter provides an overview of the international legal regime governing hazardous wastes (Basel Convention), toxic chemicals and pesticides (Rotterdam Convention), and persistent organic pollutants (Stockholm Convention) or the BRS legal regime in short. By employing a Third World Approaches to International Law (TWAIL) lens, it unpacks, deconstructs, assesses, and rationalises the rule-oriented basis of this legal regime. It identifies reasons for its efficacy/non-efficacy as against a scenario where chemicals, pesticides, and hazardous wastes that are banned, or severely restricted in developed countries, are exported to, or are produced in developing countries that follow lax environmental law standards resulting in environmental degradation and human misery. Keeping these objectives in focus, the chapter concludes by offering an assessment as to what portends for the future of this regime.
