Abstract
The procedure of international law making is undefined despite it being a fundamental objective under Article 13(1)(a) of the United Nations Charter. The primary responsibility of international law-making is bestowed on the International Law Commission and the Sixth Committee of the General Assembly. This paper shall distinctly expound the roles of these bodies in international law-making through the agenda of “Immunity of State Officials from Foreign Criminal Jurisdiction”. Furthermore, it shall delve upon the contributions made by the International Law Commission in the development of international law and argue that the subjects referred by the General Assembly are ineffective and futile. Conclusively, the paper shall criticise the procedure of international law-making to be complicated and emphasise on the importance of a coherent relationship between these two bodies for the progressive development of international law.
