Abstract
The use of artificial intelligence (AI) to maneuver in Earth’s orbit autonomously has the potential to revolutionize space traffic management, the problem of space debris, and radically reduce collisions between space objects in outer space. Use of AI to maneuver space objects promises efficiency and an important step towards long-term sustainability of outer space. However, considering not every entity and every State has the capability of using such advanced technologies, the question is how we ensure that, as society, all space actors obtain maximum benefit from these advanced technologies. The outer space environment should be protected because international space law provides that exploration and use of outer space shall be the province of all (hu)mankind and that space exploration and use should be carried out for the common interest and common benefit of all. Further, pragmatically speaking, it is in the interests of all space players that collisions in outer space are mitigated and that the space assets are not destroyed or damaged by space collisions. While existing hard and soft laws on space governance provide some guidance for standards to ensure space sustainability, considering the rapid technological progress, particularly the use of AI to maneuver space objects autonomously, it is necessary to revisit the existing laws. The paper concludes that the international community should develop minimum technical and safety standards for all satellites. In creating these standards, the national laws of emerging space nations should be particularly considered to ensure fairness and to avoid placing heavy burdens on newer space actors while ensuring protection of the outer space environment.
