Abstract
This chapter critically analyzes the legal foundations of privacy and freedom of expression in the digital age, positioning them as central to democratic legitimacy and institutional accountability. It explores the normative evolution of digital rights across jurisdictions, the jurisdictional tensions in cross-border enforcement and the systemic inequalities that hinder access to redress. By integrating comparative constitutional analysis with global governance frameworks, the chapter argues for a rights-based and inclusive model of digital regulation. It concludes by emphasizing the need for global legal standards that advance justice, transparency and institutional equity in digital governance, aligning with broader sustainable development goals.
