Abstract

This chapter examines the growing phenomenon of climate-induced displacement across borders and the limitations of current international legal frameworks in providing protection. It explores how regional cooperation, soft law instruments and human rights-based approaches are being employed to address the legal and policy gaps that leave climate-displaced persons without formal recognition. Drawing on examples from the Pacific Islands, South Asia and Sub-Saharan Africa, the analysis highlights emerging practices such as humanitarian visas, planned relocation, and regional protocols. The chapter argues for a cooperative and adaptive framework that integrates legal tools with participatory governance to ensure protection and equity. While emphasizing the relevance of climate justice and institutional accountability, it situates displacement governance within broader global objectives of resilience, inclusion and sustainable development.
