Abstract

This Article argues that the enforcement of antigay laws, which most often criminalize consensual sex between men, can constitute the crime against humanity of persecution. By analyzing the instances of enforcement of anti-gay laws around the world and the jurisprudence on the crime against humanity of persecution, this Article demonstrates that under certain conditions, enforcement of antigay laws satisfies the material elements of the crime as defined in the ICCs Rome Statute
