Abstract

The defence of intoxication and mental defect has been rife with controversy within legislative, judicial and academic discourse. In addition to this, there is confusion as to the position of the law on the defence of intoxication, as well as technical and evidentiary issues surrounding its applicability. Therefore, this paper aims at
analysing the law and the jurisprudence of the criminal law systems of India and the United Kingdom; in order to identify lacunas within the law, potential areas for improvement and the nature of the approaches adopted by the two jurisdictions.
