This paper critically examines the introduction of trial in absentia under Section 356 of the Bharatiya Nagarik Suraksha Sanhita, a significant departure from the Criminal Procedure Code that permits courts to proceed against accused persons in their absence, subject to prescribed safeguards. It situates this legislative shift within Herbert Packer’s Crime Control and Due Process models, examining the tension between preventing absconding accused from frustrating the administration of justice and preserving the right to a fair trial. It traces the Supreme Court’s recommendation for a trial-in-absentia mechanism in Hussain v. Union of India and examines the procedural and constitutional dilemmas it raises. Drawing from international and Indian jurisprudence, it argues that while trial in absentia is a conceptually efficacious remedy, its current state compromises due process and requires enhanced safeguards. The paper concludes with a call to balance the rights of the accused and the victim and to align domestic procedural innovation with comparative international standards.
