As legal reform remains a key priority for queer politics in the “Global South,” this chapter offers a cartography of the trajectories that queer politics has charted in its attempt at courting the law in India. For my cartographical explanation, I use “left legalist” traditions as a method of critically engaging with law reform. Here, I address the following queries: (1) In what ways has queer politics mobilised the constitutional pathways to enforce fundamental rights; (2) to what extent has queer politics been able to democratise its strategies and networks and (3) what are the gains and limits of adjudicatory pathways of contestation in democratic politics?

From my vantage point as a legal scholar, I submit that queer politics in India has heavily relied on adjudicatory pathways, among other constitutional pathways of enforcing fundamental rights. It is my argument that adjudicatory pathways have not only yielded mixed legal results for queer politics in India but also severely weakened its democratising character. Through my engagement with the different trajectories charted by India’s queer movements, I also argue that queer politics risks supremacist co-optation in its efforts at courting the law and, in extension, the Indian state. With that understanding, this chapter argues for reinterrogating the contemporary queer politics through the horizons of the postqueer.
