Abstract

The integration of artificial intelligence into criminal investigations has revolutionized evidence generation, offering unprecedented efficiency and precision. AI-driven tools, such as machine learning algorithms, enable the analysis of vast datasets to uncover patterns, identify potential criminal activities, and assist in decision-making. However, the ethical admissibility of AI-generated evidence raises critical concerns that challenge the integrity of the criminal justice system.

Algorithmic bias is a primary concern. AI systems trained on historical datasets can inherit and amplify existing biases, potentially leading to discriminatory outcomes that disproportionately impact marginalized communities. Such biases question the fairness and impartiality of AI-generated evidence in legal proceedings. Privacy risks further complicate the use of AI in evidence generation. The extensive collection and analysis of personal data often infringe on privacy rights, creating a delicate tension between effective law enforcement and the protection of individual freedoms.

Accountability also emerges as a significant challenge. Errors in AI-driven analyses can lead to severe consequences, including wrongful convictions, yet the absence of clear mechanisms for identifying and addressing such errors undermines public trust. Transparency is equally problematic, as many AI systems operate as “black boxes,” obscuring the rationale behind AI-driven decisions and complicating efforts to contest or verify evidence in court.

To ensure the ethical use of AI-generated evidence in criminal investigations, robust regulatory frameworks are essential. These frameworks must prioritize fairness, transparency, accountability, and respect for privacy while addressing the limitations and risks of AI technology. This article explores these ethical concerns, emphasizing the importance of balancing technological innovation with the foundational principles of justice and human rights.
