Artificial intelligence (AI) incorporation in the sporting industry has revolutionized player selection and performance analysis using data analysis methodologies. Major league clubs, like Liverpool FC, Barcelona FC, Getafe, Chicago Cubs and more, incorporate the most up-to-date AI technologies, including machine learning and analytical tools that are used in real time to assess and acquire talent, enhance practice, and design winning strategies. These technologies are quantitative in nature and fit well with the current trend of analysis in sports.

However, as of today, the use of AI in sports has not been fully integrated in India, even though it is still a future trend, as AI is still developing. All of this raises several legal and ethical questions, such as who owns the rights to the AI-based scouting reports, how and when to report data and get consent, and what happens with the data. While some general rules, for instance, the General Data Protection Regulation (GDPR), partially regulate data protection, it does not encompass all the questions connected with AI in sports. The current legal standard in India is embodied in the Information Technology Act 2000 and the proposed Digital Personal Data Protection Act 2023, which does not fully encompass the new issues at stake.

This chapter examines how AI could interact with India’s legal and regulatory framework regarding evidence laws and ethical questions around the use of AI in sports. By exposing the current gaps and proposing a future-focused model, this research helps India understand how AI can be utilized in a way that will benefit the sport while also protecting the athletes and other stakeholders.

Ultimately, the study underscores the dual potential of AI in sports: Increasing the efficiency of performance and talent management, enhancing big data and analytics, and addressing the various legal and ethical pitfalls to increase the efficiency of the performance management and talent acquisition processes.
