Abstract
India's competition law framework seeks to promote competition and benefit consumers using principles of neoclassical economics. The Competition Commission of India (CCI) has wide-ranging powers to enforce competition law and has been an efficient and productive market regulator. However, parts of the Indian Competition Act (ICA) will benefit from more clarity, such as where factors are set out on the basis of which the CCI is required to make assessments, without any guidance on how those factors are to be weighed against each other in sections 19(3) and 20(4). Recent amendments to the ICA have strengthened the CCI's enforcement powers and provided clarity to penalty determinations and merger review. Precise mechanisms need to be evolved to resolve jurisdictional conflicts between the CCI and sectoral regulators. A key development is India's proposed new draft Digital Competition Bill.
