Abstract
The debate here is one of development versus sustainability. The Joshimath area has been developed at the cost of environmental sustainability. Its growing importance and popularity as a place of pilgrimage has led to a mushrooming of hotels, restaurants, and other tourism-advancing infrastructural projects. This caused a geological disbalance, however, the reason behind it is not within the ambit of this chapter. This chapter delves into the human rights implications of this tussle between development and sustainability. Throughout the chapter, we return to the question of how the judiciary, especially the Supreme Court of India, may help fix the situation? The only way for the Supreme Court to intervene is if there is a violation of a fundamental right of the citizens. This is why it is important to find the right to a safe and clean environment, as well as the right to adequate housing within the fundamental rights chapter of the Indian Constitution. By doing so, we can allow the Supreme Court to take cognizance of the matter and order immediate and life-saving steps.
