Abstract
This chapter explores the right to privacy as a foundational digital human right, tracing its constitutional recognition across jurisdictions and its erosion through unchecked surveillance by both state and corporate actors. Drawing from comparative jurisprudence, it highlights how privacy has evolved in global legal frameworks and the challenges posed by fragmented enforcement and democratic oversight. The analysis emphasizes the growing need for rights-based digital governance grounded in transparency, accountability and judicial safeguards. As we advance into an era defined by digital transformation, the commitment to privacy must remain central, not only as a matter of rights, but as a means to reduce systemic inequality and promoting strong institutions and justice.
